1. Introduction & Acceptance
Welcome to dizomo. These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and dizomo ("we," "us," or "our") governing your access to and use of our website, mobile application, and eSIM services (collectively, the "Service").
By creating an account, making a purchase, or otherwise accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Service.
You must be at least eighteen (18) years of age to use the Service. By using the Service, you represent and warrant that you meet this age requirement.
2. Definitions
- eSIM: An embedded SIM (Subscriber Identity Module) that is provisioned digitally onto a compatible device, eliminating the need for a physical SIM card.
- Data Plan: A prepaid package of mobile data with a specified data allowance and validity period, purchased through the Service.
- Service: The dizomo platform, including the website, mobile application, eSIM provisioning, and all related features and functionality.
- Platform: The dizomo website and any associated mobile applications through which the Service is accessed.
- QR Code: A machine-readable code delivered to you after purchase, used to download and install the eSIM profile onto your compatible device.
- Activation Code: A unique alphanumeric code provided alongside the QR Code that can be used as an alternative method to install the eSIM profile.
- Wholesale Provider: The third-party provider (eSIM Access) through which dizomo sources and provisions eSIM profiles.
3. Account Registration
To purchase eSIM data plans, you must create a dizomo account. When registering, you agree to:
- Provide accurate, current, and complete information during registration.
- Maintain and promptly update your account information to keep it accurate and current.
- Keep your account credentials confidential and not share them with any third party.
- Accept responsibility for all activities that occur under your account.
- Notify us immediately at support@dizomo.com if you suspect unauthorized access to your account.
Your account is personal and non-transferable. You may not assign, sell, or transfer your account or any rights associated with it to any other person or entity.
We reserve the right to suspend or terminate your account at any time if we reasonably believe you have violated these Terms.
4. Service Description
dizomo operates as a reseller and marketplace for prepaid eSIM data plans. We provide a platform for you to browse, purchase, and manage eSIM profiles for mobile data connectivity in various countries and regions.
dizomo is NOT a mobile network operator (MNO) or mobile virtual network operator (MVNO). We do not own, operate, or manage any cellular network infrastructure.
Actual cellular connectivity is provided by third-party mobile network carriers in the destination country or region. Network coverage, speed, and quality are determined by the local carrier and are outside of dizomo's direct control.
eSIM profiles are sourced and provisioned through our wholesale provider, eSIM Access, which facilitates the connection between dizomo and the underlying network carriers.
5. Device Compatibility
It is your sole responsibility to verify that your device is compatible with eSIM technology BEFORE making a purchase.
To use an eSIM data plan from dizomo, your device must meet ALL of the following requirements:
- The device must support eSIM functionality (embedded SIM capability).
- The device must be carrier-unlocked (not locked to a specific mobile carrier).
- The device must not be jailbroken, rooted, or otherwise modified in a way that alters the operating system's intended functionality.
- The device must run a supported operating system version as specified in our compatibility guides.
dizomo provides device compatibility information as a courtesy, but we do not guarantee compatibility with every device model or configuration. If you are unsure whether your device supports eSIM, please consult your device manufacturer or carrier before purchasing.
Purchasing a data plan for an incompatible device does not entitle you to a refund if the QR code has already been scanned or the activation code has been used.
6. Purchase & Activation
When you purchase an eSIM data plan through the Service:
- The purchase becomes binding upon successful payment processing.
- Your eSIM profile will be delivered digitally via a QR code and activation codes, accessible through your dizomo account and sent to your registered email address.
- You must have a stable internet connection (Wi-Fi recommended) to download and install the eSIM profile onto your device.
- Each eSIM profile and QR code is intended for a single use and a single device. Once installed, the profile cannot be transferred to another device.
- Activation occurs when the eSIM profile is successfully installed and a data connection is first established, or when the plan validity period begins, whichever comes first.
You are responsible for following the activation instructions provided. If you experience difficulties during activation, please contact our support team at support@dizomo.com before attempting alternative methods.
7. Pricing & Payment
All prices displayed on the Service are quoted in United States Dollars (USD) unless otherwise indicated.
Prices include applicable markups and service fees. Any applicable taxes will be calculated and displayed at checkout based on your billing address and applicable tax regulations.
All payments are processed securely through Stripe. By making a purchase, you agree to Stripe's Terms of Service and Privacy Policy.
dizomo reserves the right to modify prices at any time without prior notice. Price changes will not affect orders that have already been completed.
8. Refund Policy
We understand that issues may arise. Our refund policy is as follows:
8.1 Full Refund Eligible
- The eSIM profile has not been activated (QR code not scanned, activation code not used) and the refund is requested within thirty (30) days of purchase.
8.2 Partial Refund Eligible
- Connectivity issues caused by a defect in our service or the provisioned eSIM profile that cannot be resolved by our support team.
- Cases where the eSIM profile was activated but the service was significantly degraded due to issues attributable to dizomo or our wholesale provider.
8.3 No Refund
- The QR code has been scanned or the activation code has been used, and the device is incompatible with eSIM technology.
- Data included in the plan has been partially or fully consumed.
- The plan validity period has expired regardless of data usage.
- Connectivity issues caused by the local carrier's network outages, coverage gaps, or congestion outside of our control.
- The user failed to follow the provided activation instructions.
8.4 Refund Processing
Approved refunds will be processed within ten (10) business days and returned to the original payment method. Refund requests should be submitted to support@dizomo.com with your order number and a description of the issue.
9. Data Plans & Usage
All data plans offered through the Service are prepaid and include a fixed data allowance for a fixed validity period.
- Data plans provide a specified amount of data (e.g., 1 GB, 5 GB, 10 GB) valid for a specified duration (e.g., 7 days, 15 days, 30 days).
- The plan expires when either the data allowance is fully consumed or the validity period ends, whichever occurs first.
- Unused data does not roll over to subsequent plans and is forfeited upon expiration.
- Data speeds and availability are subject to local carrier network conditions. Some carriers may throttle speeds after certain usage thresholds, as described in the plan details.
- Data plans are for personal, non-commercial use only unless otherwise stated.
10. Network & Service Availability
dizomo makes commercially reasonable efforts to ensure the Service is available and that eSIM data plans function as described. However, we cannot and do not guarantee:
- Continuous, uninterrupted, or error-free network coverage in any destination.
- Specific data transfer speeds, latency, or connection quality.
- Availability of service in all geographic areas within a covered country or region.
Network connectivity is provided by third-party mobile carriers and is subject to factors beyond our control, including but not limited to:
- Local carrier network outages, maintenance, or infrastructure limitations.
- Adverse weather conditions or natural disasters affecting network infrastructure.
- Radio frequency interference or signal congestion.
- Government-imposed restrictions, network shutdowns, or regulatory changes.
- Geographic terrain, building structures, or physical obstructions.
dizomo shall not be liable for any loss, damage, or inconvenience arising from network outages, service interruptions, or degraded connectivity caused by factors outside of our reasonable control.
11. User Obligations
By using the Service, you agree to:
- Comply with all applicable local, national, and international laws and regulations while using the Service.
- Not use the Service for any fraudulent, illegal, or unauthorized purpose.
- Not abuse, disrupt, or interfere with the network of any mobile carrier connected through our eSIM profiles.
- Not attempt to resell, redistribute, or commercially exploit data plans purchased through the Service without our express written consent.
- Not impersonate any person or entity, or falsely represent your affiliation with any person or entity.
- Not attempt to gain unauthorized access to any part of the Service, other accounts, or computer systems or networks connected to the Service.
- Not use the Service to transmit any malware, viruses, or other harmful code.
- Not use automated means (bots, scrapers, crawlers) to access or interact with the Service without our prior written permission.
Violation of these obligations may result in immediate suspension or termination of your account and access to the Service, without refund.
12. Intellectual Property
All content, features, and functionality of the Service, including but not limited to text, graphics, logos, icons, images, audio clips, software, source code, user interface design, and the overall look and feel of the Platform, are the exclusive property of dizomo or its licensors and are protected by copyright, trademark, trade secret, and other intellectual property laws.
The dizomo name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of dizomo. You may not use these marks without our prior written consent.
You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes in accordance with these Terms. This license does not include the right to:
- Modify, copy, or create derivative works based on the Service.
- Reverse engineer, decompile, or disassemble any software components of the Service.
- Remove or alter any proprietary notices, labels, or marks on the Service.
13. Disclaimer of Warranties
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.
dizomo does not warrant that:
- The Service will meet your specific requirements or expectations.
- The Service will be uninterrupted, timely, secure, or error-free.
- The results obtained from the use of the Service will be accurate or reliable.
- Any errors in the Service will be corrected.
No advice or information, whether oral or written, obtained by you from dizomo or through the Service shall create any warranty not expressly stated in these Terms.
Some jurisdictions do not allow the exclusion of certain warranties. In such jurisdictions, the above exclusions apply only to the extent permitted by applicable law. Nothing in these Terms affects your statutory rights as a consumer.
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL DIZOMO, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH:
- Your access to or use of (or inability to access or use) the Service.
- Any conduct or content of any third party on or related to the Service.
- Network outages, service interruptions, or degraded connectivity caused by third-party carriers.
- Unauthorized access, use, or alteration of your data or transmissions.
- Any other matter relating to the Service.
IN NO EVENT SHALL DIZOMO'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE EXCEED ONE HUNDRED UNITED STATES DOLLARS (USD $100) OR THE AMOUNT YOU PAID TO DIZOMO IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, WHICHEVER IS GREATER.
Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages. In such jurisdictions, our liability is limited to the fullest extent permitted by law.
15. Indemnification
You agree to defend, indemnify, and hold harmless dizomo, its officers, directors, employees, agents, licensors, and service providers from and against any and all claims, damages, obligations, losses, liabilities, costs, or expenses (including but not limited to reasonable attorneys' fees) arising from or related to:
- Your use of the Service.
- Your violation of these Terms.
- Your violation of any rights of a third party, including intellectual property rights.
- Your violation of any applicable law, rule, or regulation.
- Any content or information you submit, post, or transmit through the Service.
This indemnification obligation will survive the termination or expiration of these Terms and your use of the Service.
16. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
Any dispute arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the state and federal courts located in the State of Delaware, and you consent to the personal jurisdiction of such courts.
Notwithstanding the foregoing, dizomo may seek injunctive or other equitable relief in any court of competent jurisdiction to protect its intellectual property rights or prevent irreparable harm.
17. Changes to Terms
dizomo reserves the right to modify, amend, or update these Terms at any time at our sole discretion. When we make material changes, we will:
- Update the "Last updated" date at the top of this page.
- Notify registered users by email of material changes at least fifteen (15) days before they take effect.
- Display a prominent notice on the Platform.
Your continued use of the Service after any changes to these Terms constitutes your acceptance of the modified Terms. If you do not agree with the revised Terms, you must stop using the Service and close your account.
18. Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the original intent of the parties.
The failure of dizomo to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by an authorized representative of dizomo.
